Ronald Gordon Fleming & Love Bros. & Lee Ltd. v. HMTQ and Doug Donaldson (Minister of Forests, Lands, Natural Resources and Rural Development) (the “Defendants” and/or the “Province”)
 
Ron Fleming’s lawyers were recently successful in defending against a preliminary application brought against him by the Province in the proposed Grizzly Bear class action. The Province took the position that they needed more information (“particulars”) in order to understand the claim and to defend itself, and alleging that the claim was not well enough described. The Court accepted Ron’s lawyer’s arguments that the Province had sufficient information in order to defend the claim at this time. The Honorable Madam Justice E. McDonald, ruled that the Notice of Civil Claim filed on December 18, 2018, provided the Defendants with sufficient information to know what the Claim was and that additional particulars were not required at the current stage of the proceedings. Accordingly the Judge dismissed Province’s application and awarded costs to the Plaintiff.
 
The next date anticipated in the case is the certification hearing planned to take place in the Spring or Summer of 2020.
